Can she take the kids without my permission if my wife and I are currently separated?

Answered by attorney Reshard Juquin Alexander (Unclaimed Profile)
Divorce lawyer at RJ Alexander Law, PLLC
This is a complicated issue and more information must be known before you can receive a definitive answer. How long have you lived in Texas? Are you divorced? Where is the divorce decree? United States? Australia? Is there a custody order in place? You need to quickly consult a local family lawyer if she is planning to leave the local city where you live with the kids.

If my husband pulled money out of his savings plan at work and bought us a house i have no rights to it?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
It depends on when he bought the house. If he bought the home before you were married, the house is is separate property except for any money you paid into purchasing the home, making mortgage payments, or improvements to the property. If he bought the home after you were married, the house is your community property and you are a 50% owner of the home without regard to where the money to purchase the home came from. There are some exceptions to these general rules, but that's the basic idea. Can retirement earned prior to marriage be taken in divorce since I paid 3 out of 33 years to social security while married?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
Social Security is governed by federal law and will not be divided in a divorce. Private retirement funds can be divided but what was acquired prior to marriage is separate property. I suggest you hire a lawyer.
