My husband and I are separated he took my car it’s under my name only and he refuses to give it back can I report it stolen

John Michael Frick
Answered by attorney John Michael Frick (Unclaimed Profile)
Divorce lawyer at Reid Dennis Frick, PC
If you purchased the car during your marriage, it is most likely community property regardless of being registered solely in your name.  Reporting it stolen probably will not be an effective way to get it returned. You should ask your divorce attorney to request temporary orders in your divorce proceeding awarding you the exclusive use and possession of the car during the pendency of the case.  If he refuses to return it then, your attorney can file a motion for contempt against your husband.  That is likely to be a far more effective way to get it returned.  Once you have been awarded the exclusive use and possession of the car by the divorce court, law enforcement may be willing to help you because his refusal to return it could be prosecuted as theft.  In my experience, police won't necessarily bring charges, but will stand there with you while you take the keys and drive away to keep the peace between you and your husband.

Can my husband just kick me and my son out?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
If he throws your things out call the police. That is your home and even if the house was his before you got married, you have an interest in it for payments made on it during the marriage. You might want to file for a restraining order at your local court before he does anything as dramatic as throwing you and your son out of the house. It all sounds very dangerous.

How do i get my name off of a mortgage loan.

John W. Havins
Answered by attorney John W. Havins (Unclaimed Profile)
Divorce lawyer at Havins & Associates, PC
You asked:  How do i get my name off of a mortgage loan.Additional Details:when the ex and i filed for divorce, i gave her the house along with the mortgage loan. the judge stated she was responsible for the loan and she filed a quick claim deed, however chase manhatten does not recognize this and refuses to take my name off of the mortgage. now i cant qualify for a loan because my name is already on her loan. how do i get my name off the loan I am a Michigan attorney, and would recommend that you talk to a local attorney; however, I believe I can give you some guidance.  A Judgment of Divorce cannot change the contract you have with the mortgage lender.  Even though the Judgment of Divorce may award the house to your ex-wife along with the debt obligation, If she fails to pay the mortgage, you could be sued, but you would have the right to seek reimbursement from your ex-wife.  I usually include in the Judgments I prepare a provision that the person receiving the house gets the debt, and must refinance the debt into his/her name within 90 days.  Once she refinances, then you would not longer be obligated on the debt.  You should check your Judgment of Divorce to see if that provision is included.  If so, and if your ex-wife refuses to refinance, then you may have to file a motion seeking help from the Court.
