Inheritance is separate property and not subject to division in a divorce. Inheritance can be considered, however, for awarding spousals support and/or attorney fees.

Can I make my husband pay alimony?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
If you are wanting to divorce file a petition for dissolution. Also file a request for orders and ask for spousal support, property control so he cannot keep entering the home and what debts you want him to pay. Hire an attorney and ask him/her to get temporary support orders and attorney fees. If you have children you also need immediate custody/visitation and child support established.

How does he go about ending that marriage so we can move forward with our marriage?

Your fiance would have to file for a Nullity or divorce of the prior marriage. He would have to use the name of the spouse that he knows and then obtain an order to serve the Summons and Petition by publication in a newspaper. An experience attorney can advise your fiance.
