In general, your husband is entitled to 1/2 of the community property portion of your retirement (that portion which was earned after the date of marriage and prior to separation).

Will I be able to get any alimony when I finally get divorced?

default-avatar
Answered by attorney Eric K Johnson (Unclaimed Profile)
Divorce lawyer at Utah Family Law LC
Alimony is based, essentially, on proving you need alimony and that your spouse has the ability to pay alimony. In other words, you need to show: 1) that you cannot or should not work to earn all the money you need to meet your expenses for the lifestyle to which you have become accustomed during the marriage. 2) that your spouse can and should, after meeting his expenses for the lifestyle to which you has become accustomed during the marriage, has money left over to pay to you as alimony. Convince your judge of need on your part and ability to pay on your husband's part, and it'll be hard not to be awarded alimony, in most cases.

Can my attorney withdraw from my case?

Laurel Stuart-Fink
Answered by attorney Laurel Stuart-Fink (Unclaimed Profile)
Divorce lawyer at The Law Offices of Laurel Stuart-Fink, P.L.L.C.
Your attorney can request the court to permit withdrawal. It's probably best that you look for an attorney you get along with better.
