Is it a state law case or a federal crime? If state, and only conviction, yes, you can apply after 5 years. If federal, presidential pardon is only option.

.There are many factors that would need to be considered and evaluated. Do you know if you are being charged with felonies, misdemeanors or both. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case.

If the law did an investigation and found enough evidence to put that charge on me, would they put a warrant for that crime out on me immediately?

Not necessarily. There are MANY factors that go into when an actual warrant is issued, such as: 1) how busy that particular police department or prosecutor is; or 2) they may think you are part of a gang or organized crime, and they want to "get more" evidence on you or a suspected gang member. The most important thing for you to do is immediately hire a lawyer as soon as you are formally charged, to ensure your rights are protected.
