Every prior, whether a strike or not, adds enhancement to sentencing. You'll learn the actual charge[s] filed and any enhancements, priors, or violations alleged, and get copies of all the police reports and prosecutors evidence when appearing for arraignment at the first court hearing. A little free advice: exercise the 5th Amendment right to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

How can I defend myself from a DUI if my friend was driving?

You drove to where you parked and slept, didn't you?! Is your friend going to spring up and say, "Wait! No! Hey! I was driving, not my innocent Budrow there!" If not, you have problems. Can you prove that you drank after you drove (i.e., after you parked)? I really hate to see the cheesy District Attorney file this crap, after the cheesy cops made the fraudulent arrest. On the other hand... You have no witness, apparently, and you were "somehow" sleeping in the driver's seat (yeah, right). I mean, how could your friend "drive" if you were sleeping in the driver's seat. I do not know what else to tell you, my friend, but you need an evidence make-over.

As that is a misdemeanor, you potentially face up to 6-12 months in jail plus fines. That is actually not likely to be imposed unless there are really aggravating circumstances. I assume your license was suspended by DMV for getting the DUI. The judge and DA will not be thrilled with you driving, especially since the suspension was for DUI. Effective plea-bargaining, using whatever defenses and sympathies you may have, could possibly keep you out of jail, or at least dramatically reduce it, depending upon all the facts and evidence, and your rap sheet and priors. Not exactly a do it yourself project in court for someone who does not know how to effectively represent himself against a professional prosecutor intending to convict you. If serious about hiring counsel, feel free to contact me. Ill be happy to help you use whatever defenses you may have. If you can't afford private counsel, apply for the Public Defender.
