At age 14 in New York State you are still a minor. If you are arrested, your case will be in family court as a juvenile delinquency proceeding, and not in the adult criminal courts. It will be a good wake up call to turn your life around without giving you any criminal record. Your attorney should be able to help you through this, but it will be a good idea not to make these trips to family court a regular habit. At age 16 in New York you are fully an adult for criminal purposes, and drug use will give you a very different experience in the court system.

This is terrible! But unfortunately, it happens a lot. Public Defenders and the courts are overwhelmed now, and the situation is getting worse the more deeply the State sinks into the budget abyss. On the other hand, the Constitution guarantees that anyone charged with a crime be provided with competent legal counsel if indigent. No lawyer can advise you as to the specifics of your brother's case without having all the information, and it may be that the evidence against your brother is strong, but these are very serious charges. No innocent should be pressured take a deal, especially one so young. He has a right to a trial in addition to competent legal representation. Honestly, from what you describe, you really need to have your family gather their resources and hire a good criminal attorney for your brother, one who will fight for him and is not afraid to try the case. At the very least, he/she should communicate with your brother, investigate the case, and explain the case to his family so they understand what is going on. Beyond that, however, I can not offer any solution.

Is there a chance? Of course. You are free to represent yourself if you would like. Should you do it? That depends on you. Will you have time to research relevant legal issues and argue it accordingly, without saying the wrong thing to the DA? Do you have a sufficient understanding of legal rules, concepts and their interpretations?
