If a person presses charges against, can they remove the charges?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
No. The DA's office has the authority to accept/reject charges. So, the person didn't "press charges" against you in the first place. They called the cops. The cops made a report. The cops called the DA's office and asked whether they would accept charges against you. And the DA accepted those charges. The person who called the cops initially can certainly refuse to cooperate with the prosecution, or make it difficult for them to prosecute. The best thing for you to do is to hire a lawyer you trust, and have that person explain to you the possibilities.

Can a 12 year old be questioned without a parent?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Depends on where, about what and by who. Kids have limited expectation of privacy in school, so be careful there. It's going to be very fact specific. Need more info.

What type of attorney do i need to represent me?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
If there is no witness against you who can say that they personally know or saw you take the money you will be found not liable for damages. You do not have to hire an attorney to defend you unless there is more to the claim than in your inquiry. Your brother must show that there is proof of you being the thief, not a guess. It is up to him to put on the evidence that you took the money. If he has an attorney, you may want to hire an attorney who does civil defense work to be sure that you answer all discovery properly and to file a motion for summary judgment. You did not say how much loss the theft caused. Unless the amount of money is fairly large, the attorney may cost more that it is worth. A simple consultation to discuss the procedures needed to defend yourself may be worthwhile.
