Do I need an attorney to turn myself in for a bench warrant?

Answered by attorney Andrea Rogers (Unclaimed Profile)
Criminal Law lawyer at The Rogers Law Firm
You definitely need to hire an attorney to represent you in court. Your attorney can lift the warrant and then negotiate a plea bargain with the prosecutor to keep the shoplifting charge off your record. If you turn yourself in, you will have to pay the bond in order to get the warrant lifted and obtain a new court date. Or you can turn yourself in and sit in jail until the next time they have court. The warrant is not withdrawn until you either pay the bond, turn yourself in, or hire an attorney to get the warrant lifted.

Being released means nothing. Most people are released after being arrested unless they are held on bail, which is a question of flight risk.

There is a great probably that he will spend 3-6 years in prison. However, the time in each county can be run concurrent. So, it does not matter whether the violation of probation comes first or the new charge sentence comes first.
