If you are unhappy with your appointed attorney, you may wish to speak to and potentially hire a privately retained attorney. Some Judges frown upon such a move when done immediately prior to trial starting, so if it is something you are considering, you should do it sooner as opposed to later. That being said, it is possible that there is no merit behind the motion. I can not say one way or the other since I know nothing about your case or which motion you would like filed.

The legal consequences are probably up to 3 years in custody, but this maximum sentence is not likely to occur - at least initially. He will probably be given the opportunity for drug treatment. The real consequences are physical, mental, and emotional to say nothing of the damage to loved ones caused by drug use. Your friend is so young. I hope he/she gets the help he needs and turns his/her life around before it's too late.

Why was your friend stopped in car in first place? There are diversionary programs to ensure that there is no conviction. He could fight the case but that may be risky depending on the facts. It sounds like he may have a winnable case, however.
