In Texas, you can be convicted of any offense, including murder, as a party to the offense which means even if you did not do the actual crime, you can be charged, convicted, and punished just as the primary actor (except that you cannot receive death in a capital murder as a party in some instances.)

How can I stop someone from accusing my daughter of breaking and entering?

Michael R Garber
Answered by attorney Michael R Garber (Unclaimed Profile)

No one can stop anyone from making accusations. The police and prosecutor looks to see if there is any evidence to support the allegations. If not, nothing happens. If there is, she could be prosecuted.

Do the police have a strong case against me if they dont have a arrest report?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The police produce an arrest report to support a warrant for arrest and for later prosecution. If no arrest report was written then there is not enough information to charge a crime. If you are a suspect it is best for you to consult with an attorney to help get the correct information to the investigators before a warrant could be issued.
