In order to do 180 days, you have to plea guilty. If you are pleading guilty, then you have a jury trial. Simple.

It all depends on the terms of her initial probation. Generally the police and probation officer are allowed a warrantless search of the residence of a person on probation because, on probation, they have lost many of their civil rights and would otherwise be incarcerated and must comply with probation and ordered to remain outside of jail. Now you both need an attorney, preferably separate attorneys.

Unfortunately, they can keep him in jail until his trial is over. Although his public defender waived his right to a speedy trial without his permission, he should have said something to the court, notifying the court that he did not wish to waive this right. If he remained silent, the court most likely took his silence as agreeing to the waiver.
