What are the chances that the judge will give me a UA when I go back to court and what happens if I fail?

DUI is NOT limited to just alcohol. A DUI is driving under the influence of alcohol and/or drugs. That includes marijuana! Yes, the judge could order a UA, if he/she has reasonable cause to believe you are in violation. Non-compliance with the court's order is reasonable cause. If your UA comes up dirty, you will probably go to jail. It is ultimately up to the judge.

Is it an in-house policy which the DUI Program enforces, or is it at the State or Court level?

If you are in Missouri, I'm not sure what program you mean. If SATOP, and you get a second DWI, you would have to undergo more extensive counseling.

Can the officer/judge charge me with a DUI when I go to court, will it come up and do you think one would do that?

They will not do anything at court. I am guessing that the cop tossed the marijuana. If he did not do field sobriety tests, check your balance. or he did not require you to do a blood test they would have an almost impossible time proving you were under the influence.
