Can a misdeamor be changed to a felony?

Answered by attorney Andrew Daniel Myers (Unclaimed Profile)

There's no magic wand and the question can't be answered without knowing all of the facts in order that the allegations can be compared to the range of criminal laws that might apply. At that point a "plea bargain" may or may not be possible. But again, no attorney can answer this question in a vacuum until after talking to you and I highly recommend that you obtain a consultation with a criminal defense attorney.

Was the arrest legal?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
You need to hire a lawyer to represent your daughter. You do not say what she was arrested for. She had a prescription and if there is no evidence she took the guy's Xanax, then she has not broken the law. And, if the person was not a cop, then they pulled one over on your daughter but the police are not responsible for that person's actions. If she was a cop, she acted illegally.

What can I do if I was given a bad check?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Wait, so you never cashed the check, you just started spending money that you thought the check would cover? Then that's a breach of contract civil suit and you can press charges for writing a bad check.
