Can I get several misdemeanors expunged from my record?

Thomas J Tomko
Answered by attorney Thomas J Tomko (Unclaimed Profile)
Criminal Law lawyer at Thomas J. Tomko, Attorney at Law
n Michigan, the answer is no. An OWI is a traffic misdemeanor. It cannot be expunged. The rule is one conviction and 5 years going by before expungement is possible. In your case, the several convictions prevent you from expungement eligibility. I hope that this was helpful.

Can I be charged criminally if I took a deposit and backed out?

default-avatar
Answered by attorney Paul J. Adras (Unclaimed Profile)
Criminal Law lawyer at Las Vegas Criminal Defense Attorneys Adras Altig
This questions involves a civil matter sounding in breach of contract; however, if a person takes a deposit from someone knowing that he or she cannot perform the work, then he or she may have committed fraud and criminal charges can be brought against that person. In order to prove fraud, the person must have known or had intent from the beginning that he or she was just taking the money without ever intending to perform.

Should I turn myself in to the police?

default-avatar
Answered by attorney Michael Thomas Lynch (Unclaimed Profile)
Criminal Law lawyer at Michael T. Lynch
Please do not speak to the Police. You have no duty to prosecute yourself. If you insist upon exposing yourself do so only with your attorney present at all times. Most likely the Police do not have the evidence necessary to convict you, that is why they want to speak with you. Do not give them the chance. If you do, you most likely will be convicted and sent to rehab. If your experiments with drugs is complete and you are ready to live a drug free life, skip the middleman and enter rehab on your own.
