Can my son be arrested for minor in consumption of alcohol if he was never tested?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Yes, if they saw it, he admitted it or smelled of it. It will be hard to prove he consumed in Court, but then again this is a small case and will cost you to fight it that hard.

My husband has two pending charges and may possibly be charged as a Habitual Offender. What can be done to avoid a Habitual charge?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Under the right circumstances, one or both paragraphs may be waived. Drug treatment is sometimes useful to reduce the penalty. Where the case is pending has a great deal to do with offer is made for a plea.

Can I go to jail for outing my husband’s mistress on the website that she's a homewrecker?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
As long as you are not sending repeated messages that are harassing her, and you are simply telling the truth, you have no problem. (Truth has to do with the potential?civil lawsuit. Single message has to do with harassing communications that could lead to criminal charges.) As much as she aggravates you, don't do it again.? (And she is not the homewrecker - your husband is. She does not owe you - he does. IMHO and having been on the receiving end of same....)
