What recourse do we have for an indictment that is wrong?

Answered by attorney William R. Pelger
Criminal Law lawyer at Pelger Law
Don't call me. I am in PA and cannot help you. Ask a TX lawyer. When you deal with a court appointed lawyer who won't return callls, my advice is always the same. Be patient and polite but be persistent. Only if this fails do you take the more drastic step of requesting a new lawyer from the court. I couldnt tell you if meth or heroin carries more of a sentence, but the prosecution can always amend their charges up to the date of trial in most states-again ask a local TX lawyer.

Is it normal for your.lawyer not to inform u about your case whil incarcerated?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Your lawyer should communicate with you while you are incarcerated at several times. First to discuss the facts, second to discuss the states position on your case and any offers that have been made and again to make a decision as to how to proceed (trial or plea). If trial, then several visits to get prepared. This is the minimum au should expect. There may need to be bond discussions, witness questions and other issue discussions.

What can I do if I was charged for a burglary while I was under heavy medication?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
How do you know you did all that stuff in such specific detail if you have no memory of it? It doesn't even sound like you stole anything from what you described. Have a criminal attorney review the evidence against you in order to give you more specific advise to your situation. Even if the hospital was negligence, that would never absolve you of any criminal liability. At best, you could enact a civil action against them for damages.
