If it's a misdemeanor theft (less than $500), then the potential sentence is up to 1 year in jail and up to $1,000 fine. He needs to hire an attorney to represent him to keep this off his permanent record.

You asked: How can I not get arrested? Answer: Don't steal other people's property would be a start. Depending on the amount, you could be charged with grand theft or petit theft. Also, you could be charged with forgery, and/or uttering a forged instrument. Stores have video cameras, you know. It shouldn't be tough to find you. It wouldn't be a bad idea to pay her back before the cops snatch you up.

It certainly can. The police have let child services know what is going on, because there may not be enough to arrest you. While they are investigating the case, they want to make sure the children are safe. If the children reveal anything to child services, it will be used against you.
