Accidental stealing. When you find someone in your vehicle, will you believe that they it was their vehicle? YES, well then you assume that everyone is as gullible as you.

What would be my punishment or my penalty for a third degree theft?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Hire a lawyer to represent you. In Texas, that charge would be a state jail felony unless you have prior felony convictions. A third degree felony carries from 2 to 10 years in prison. (A state jail felony carries from 6 months to 2 years in state jail.) If you have no prior criminal record, you qualify for deferred adjudication probation. Depending on the facts, you may be able to get a pretrial diversion and remove this case completely from your record in the future. Charges can be reduced, too.

You can be charged, especially IF the perpetrator explains that you provided the vehicle and/or gun with full knowledge of what would occur.
