How will a DUI affect my license?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
Criminal Law lawyer at Law Office of Joe Dane
Yes, it will impact your license. First, you only have 10 days from the date of your arrest to challenge the automatic suspension of your license by the DMV. If you're convicted of DUI or you lose your hearing with the DMV, your license will be suspended for 4-6 months. You can get a restricted license after 30 days if you sign up for an alcohol program, have current insurance filed with the DMV and pay the re-issuance fee. That 30 days is just that - 30 days of actual suspension. If you are caught driving during that 30 day period, it's another misdemeanor and could result in jail time. Your first step should be to sit down with a local criminal defense attorney that routinely practices in the court where your case will be heard. Don't miss that 10 day window to contact the DMV. Best of luck.

What are considered unethical practice by an opposing attorney?

Answered by attorney Craig W Elhart (Unclaimed Profile)
Criminal Law lawyer at Craig W. Elhart, PC
An attorney should act in a professional manner. However, attorneys are human too. As for the threat, what was actually threatened? It may be that the conduct bordered on unethical but more information would need to be known. When a court date is set, a notice must be sent to all parties involved. If a person is represented by an attorney, the notice would be sent to the attorney. If a person is not represented, the notice would be sent to the person at his/her last known address. If a person moves and does not provide notice of the change of address, mailing to the last known address is all that is required by the Michigan Court Rules.

Warrant

Answered by attorney J. Allen Fiorletta
Criminal Law lawyer at The Fiorletta Law Group, PLLC
Since this is your first offense, you may receive a PR bond, or a 10% bond. Whether you receive jail time will likely depend on what, if anything, you are ultimately convicted of. You should certainly discuss your situation with an attorney before making any decisions on how to proceed.
