Yes it is. If you are not represented by an attorney, I suggest that you hire one immediately since all theft charges carry potential jail sentences.

What will happen in court if a 17 year old gets charged for sleeping with a 13 year old but she lied and said she was 16?

Your boyfriend needs an attorney as soon as possible. It doesn't matter if she lied about her age. It is still illegal to have sex with her. Your boyfriend should not talk about this with anyone else, especially the police. Under no circumstances should he talk to the police without his lawyer present.

I would retain an attorney to write him a letter demanding that he offer proof that you stole from him. On the surface it sounds like he is shaking you down for money which puts the criminal activity on him, not you.
