The state has about a month to file an information. More facts are needed in order to answer your question more fully. The arrest starts the procedure going, it goes to the state attorney who files an information charging him with the crime. That usually takes over a week, sometimes more, sometimes less. If he has been in jail since, over 30 days have passed, and the state has not filed an information, he should get an aggressive criminal defense attorney in Orlando to fight the case.
