How can i get my misdemeanor case of possesion of cannabis and drug paraphernalia thrown out so, I dont have anything on my record?

Based on your facts, you may be able to file a motion to suppress.  If the court finds that the officer had no right to search you and that you did not consent to the search, then it should grant your motion.  That would mean the state could not use the evidence (i.e., cannabis and drug paraphernalis) against you at your trial.  Most likely, if the trial court grants a motion to suppress the evidence, the state would appeal before proceeding to trial -- or drop the case before trial.   However, it is likely that your statement of the facts may not correspond to the officer's statement of the facts.  Then the judge would have to decide which set of facts are most credible -- and would decide, based on his/her finding of the facts, whether to suppress the evidence.   If you do not want to proceed with a motion to suppress, the state in some areas will offer a diversion or drug court program.  If you are accepted into the diversion program and satisfactorily complete it, the state may drop the case.  The state does NOT have to offer diversion.
