Can I be charged with a DUI if the keys were outside of the car and the arresting officer smelled?

Answered by attorney Robert Edward McCall (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Robert E. McCall
Florida law doesn't care about the keys. Our statute says if a person is in "actual physical control" of the vehicle they can be arrested for DUI. Sleeping in the back seat of a car, keys with someone else a person can be arrested and found guilty. Unfair? Yes, talk to the democrats in the legislature they passed the law and block any changes.

How does one fight a DUI in a different state?

Answered by attorney Andrea Rogers (Unclaimed Profile)
DUI/DWI lawyer at The Rogers Law Firm
Yes, you definitely should fight it because a DUI conviction in another state will be reported back to your home state and your license will be revoked. Hire a DUI attorney who practices in the city or county where you received the out-of-state DUI.

If the officer no longer employed how will this effect my case?

Answered by attorney Eric J Trabin (Unclaimed Profile)
DUI/DWI lawyer at The Trabin Law Firm, P.L.
Possibly. The officer could theoretically still show up to court, however, it is a lot less likely whether the officer will show. If the officer does not show up for your trial then the case will likely be dismissed.
