What is the maximum jail time someone can get for criminal felonies such as attempting to elude a police officer?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
This is a complicated question to answer with the information provided. Usually the sentence for eluding police is a maximum of 3 years. The reckless driving and possession of alcohol by a minor under 21 are usually filed as misdemeanors with a maximum jail sentence of 1 year. The probation violation will depend on why the person was on probation and what charges were filed in the other county. Sentences can run concurrently or consecutively depending on the charges and other factors. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your friend's arrest and his criminal history. He/she would then be in a better position to analyze his case and advise him of his options.

Gun charge

Glenn D Kassman
Answered by attorney Glenn D Kassman (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Glenn D. Kassman, Esq.
The State must prove that the gun belonged to your son or at least that he was aware that it was in the car and was capable of exercising control over it--what the law calls "constructive possession."  You didn't say in your question where the gun was located in the car or whose car it was, but the more hidden the gun was, the more difficult it will be for the State to prove that your son knew it was there.  As for your son finding out later who the gun belonged to and informing the police, there are two issues: (1) Any statement by your son that the gun belonged to someone else in the car will sound self-serving and is not likely to be believed by the police unless there is something to corroborate it; and (2) It is not possible to predict whether your son might face possible retribution by the real gun owner if he implicates him.

Can a police still ask you some questions after asking for a attorney?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
If you are not in custody, then the Miranda protections do not apply. Custody usually means handcuffs and jail, but not necessary at the police station if entered voluntarily. Asking for an attorney is the best thing to do other than saying nothing else. Some crafty Detectives will get the interview after you invoke your right to an attorney so that you cannot testify in your defense at trial. This is based on the rule that the court can suppress the statement for the prosecution case in chief, but that the statement can be used to impeach the defendant if he testifies differently. There a lots of ins and outs on Miranda law, demand an attorney and say nothing else.
