Do I just wait for a ticket if I was caught underage drinking but the cop let me walk home?

default-avatar
Answered by attorney Michael Joseph Redenburg (Unclaimed Profile)
Criminal Law lawyer at Michael J. Redenburg, Esq. P.C.
Sounds like you caught a break. The officer probably could have issued you a summons for open container, but instead, in his discretion decided to let you go home and sleep. Based on the information you provided, I doubt you'll ever hear anything else about this incident. If by some chance you receive a summons/ticket in the mail or by some other means, you must answer it, however.

Do I have to give my DNA in a criminal case

Answered by attorney Michael A. Schillinger
Criminal Law lawyer at Law Office of Michael A. Schillinger, Esq.
The answer here may depend on whether you are pre or post conviction. If you pled guilty for instance, (or were found guilty at trial) and you now stand convicted of a criminal charge, you may have to give DNA because you were convicted. With that being said, you should ask your attorney about that if that's the case.    If you are pre-conviction and the case is still pending, then it will be specific to your case - in certain circumstances the D.A. can attempt to get a force order to have you swabbed for DNA. Again, this is really something you should be speaking with your attorney about, and he/she should be able to advise you on this.

What are the approximate penalties for purchasing an unknown counterfeit product?

default-avatar
Answered by attorney Jared Altman (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared Altman
First, I'll bet she had to know it was counterfeit to break the law, which she didn't. As for penalties, they could be quite severe. A sentence depends on a lot of things like the exact charge(s), how cooperative the complainant(s) are, any injuries or property damage, the criminal history (including all arrests even if no convictions), behavior towards the arresting officer(s) and other factors.
