Either the judge says credit for time served, or it is automatically applied, because there are no other charges or holds on the person.

Anyone who files a false police report in California is guilty of a misdemeanor with a potential jail sentence of up to one year. However, the D.A. may not believe you if there is physical evidence (the scratches) that your boyfriend attacked you and may continue to press charges against your boyfriend. Good luck.

Make sure she has good legal representation. Check for experienced criminal attorneys in your area that have experience in these types of cases. Don't make any statements to the police or other authorities without speaking with a lawyer first.
