Can an inmate that is eligible for parole file a motion for sentence reduction and it cannot be seen negatively by parole?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
First, an inmate cannot file a motion for sentence reduction with the parole board, it must be filed with the original sentencing court. I suspect that the time for filing sentence reduction may have passed IF he is now eligible for parole. However, because the parole board rarely even finds out that a sentence reduction have been filed, he can try to file for it. Second, wearing of bracelet is not time in jail, so it does not count as jail time.

Can I do anything about a neighbor making false noise complaints?

I suppose that the only thing you can do is have an attorney write a letter filled with words that she will not understand which make it sound like something bad is going to happen to her if she does not stop making complaints.

I have a warrant for missing court for a $5 bag of marijuana probation case. I owe for fines. I have 3 children and concerned about going to jail

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
I suggest you turn yourself in since you know there's a warrant for your arrest -- and ask for an attorney from the Public Defender's Office to represent you.  You are entitled to have an attorney represent you on VOP cases.  But when you go to court, you will need to ask the judge for one to be appointed.  If the judge determines you do not have sufficient income or assets to retain an attorney, the judge should appoint one to represent you if you ask for one.
