Can my girlfriend be arrested for theft with only accusation and circumstantial evidence?

Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
The charge is based on accusation, circumstantial only can convict but the profs at trial are substantial and difficult in such circumstances. STOP talking with the police and start speaking with an attorney.

Am I still up for some jail time if I plea guilty for shoplifting?

Answered by attorney Kevin T. Ellmann
Criminal Law lawyer at Ellmann & Ellmann, P.C.
While jail time is possible for a misdemeanor or petty theft conviction, it is unlikely based upon the information you provided. It largely depends on the dollar value. However, your juvenile adjudication is a sealed record (not public) but if you plead to a theft charge straight up, it will forever be part of your publicly accessible criminal history. You should therefore think long and hard before simply pleading to this charge. I have several people call me every year who "plead to a shoplifting and got a fine" when they were younger and 10-15 years later, they can't get a job because it keeps showing up on their background checks. I would urge you to consult with an attorney!
