How long should my brother get for 4 counts of unlawful entry, 4 counts of theft, 1 count of receiving stolen property?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
That is impossible to answer. The sentencing judge considers many things, such as criminal history and the facts of the case, employment history, alcohol/drug abuse issues to name a few. What he can potentially GET if convicted of all the charges is easier to determine, but I would still need more information. If by "unlawful entry" you mean a residential burglary, he would be looking at a maximum exposure of 10 years on four separate counts (and four strikes). But even that is stretching what can accurately be stated because the facts - and the applicable law - add into the equation. If those are 4 counts of second degree burglary ("unlawful entry" of a store, let's say and not a residence), he is looking at a maximum on those counts of 5 years (with no strikes). Get him a good lawyer - he's going to need it!

Can you get in trouble for asking to buy psychedelic mushrooms and driving a friend to the deal?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Possibly, but if you have not been arrested yet, then highly unlikely you were complicit in the purchase because you wanted it to happen and helped it to occur - complicity means that you are every bit as responsible as the person that did the thing so, be happy your friend did not rat you out be ready to tell police that you want an attorney and do not want to talk without one.

Do DA's actively press statutory rape?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
Someone would have to bring it to the DA's attention. DA's do not regularly search birth records looking for the ages of the parties involved. Also, are you sure that you are guilty of statutory rape? In Utah, it is not illegal for a 22 year old to have sex with a 17 year old. Make sure you know the laws of your state, and hire an attorney if necessary.
