What are my options if I was caught smoking marijuana in a car with two others with no intent to drive any time during the intoxication?

You have but 3 options. 1. Have your lawyer file a 4th amendment motion to try to establish the detention, search and arrest were without probable cause and get the evidence suppressed. 2. You can go to trial on the case to make the State prove their case beyond reasonable doubt. 3. You can plead guilty for supervision if you have little or no background.

Does a cop have to read me my rights if I was put in cuffs but I did not go to jail?

Answered by attorney Marshall S. Tauber

What the lawyer said is partially true. What you SAY cannot be used against you if you said something in response to police questioning & they did not warn you first. But, if you just said something without being warned then you waived your right to remain silent. I would suggest you look for a more enlightened attorney.

Is there a statue of limitations on probation violation?

Answered by attorney Michael D. Fluke
Criminal Law lawyer at Michael D. Fluke, P.A.
There is no Statute of Limitations on a vop. Often times attorneys can take care of old vops without significant court action. It depends on the charge and the circumstances. I suggest you consult an experienced Criminal Defense attorney to discuss your case in greater detail and learn all of your rights and options. Good luck.
