Nobody has to talk with the police, ever. The cops will say cooperation will be noted and helpful. But, it is only helpful to the cops and DAs and noting the cooperation is rarely, if ever, going to get you a better deal. If the police want to talk, it usually means that they think they have proof problems and want the suspect to help fix the problem. Why help? Remember, after the case is filed, we can always tell them our side. Also, cops rarely record the statement and often misinterpret it in their reports. The make it sound like you said something you did not, or in context, did not mean. You are left trying to tell a jury that the cop got it wrong. If there was a recording, then you have some protection, but not much. Ask for an attorney and do not talk with the police until you have one.

Is possession of narcotic a misdemeanor or a felony?

It is a felony. Why do people ask questions they already know the answer to? I was charged with possession of a narcotic, therefore you will be facing possession of a narcotic charge. This is not rocket science. Once you work with police, you have admitted your guilt, and need to pray that they offer you a plea you can live with. You need to also make sure that none of the dealers you set up know where you live. They are funny about things like that.

Second degree assault with those facts is a mandatory prison sentence and that means real prison - if you are convicted, you will be sentenced to a minimum of 5 years of prison with parole possible at 40% of that sentence often, a plea to felony menacing is offered to avoid this mandatory prison a good lawyer may be able to do better than that.
