It depends many factors including the circumstances and intent. Sometimes the defendant will be indicted for both murder and manslaughter. In that situation  once there is a conviction for murder then the jury does not consider the lower count of manslaughter.

I can't think of any reason why you would want to fight it. The charges will be dismissed why argue with that.
