As with any criminal charges, you should defend the charges, negotiate an acceptable plea bargain or go to trial. This site is not going to give you a philosophical education into political justification for disparate treatment. Youve been offered a plea bargain. Either take it or go to trial. Bringing in an attorney now is not likely going to improve the offer, or at least not by much. If you want to go to trial, feel free to contact me for that help.

You filed a motion to withdraw your plea. which was denied in the lower courts? IF yes, then you will return to the lower courts IF the appellate courts grant your decision. I cannot imagine what you would have filed that will result in an outright dismissal, considering that you have almost completed two years on probation.

The use of handcuffs is not dependent on a person's age. In general, a police office can take a person into custody and handcuff them. If there is no probable cause to do se, then there may be a civil rights violation. If charges follow, then there will generally be no problem with handcuffing a person for the officer's safety as part of police procedure. I hope that this was helpful.
