The store may keep items in order to do further investigations. No good attorney will tell you to plead guilty if you have a valid receipt for items.

It depends on the Municipal Prosecutor.  find a local ordinance violation like failure to dipsose of garbage, or littering or somthing else that you can offer to plead to in order to avoid the criminal penalty.  If you cannot make a deal with the prosecutor, ask for an adjournment so you can ire an attorney.
