The client should tell the public defender he is firing her. The client and public defender may both be required to go to court personally and tell the judge that he wants to fire her and hire a private attorney, or the court may allow the public defender to file a motion to withdraw on the grounds that the client has requested that she withdraw. The client can call the court clerk and ask what the procedure is for firing her public defender, or the client can call the public defender's office and ask.

Yes. The fact that your son wasn't booked (photographed and fingerprinted) at that time doesn't mean that he won't be charged at some point in the future. The police can still be conducting their investigation. Nonetheless, just because your son has not been charged at this point doesn't mean you should just wait. Given that the police are investigating your son, I would suggest you hire an experiences criminal defense attorney to represent your son. Depending on the facts and circumstances involved, the right attorney might be able to avoid charges against your son altogether.

However, if your not detained nor in custody [note: custody can be more than simply being handcuffed/jail e.g., police not letting you leave] then the police may attempt to question you claiming that they are simply investigating and have not charged nor arrested you. However, you have the abolute right to not say anything and should exercise it because anything you say can and will be used against you.
