If you trust your attorney, he or she should be able to put the best defense forward to avoid jail time. I am a bit surprised that you are looking at any jail time for what sounds like the 3rd entry in your record, preceded by one prior theft and one underage drinking? Something doesn't sound right. Unless the amount of the two thefts, previous and the current, are substantial, I don't see why jail is even an issue. What you should be looking for is restitution and probation, most likely with a CWOF (continued without a finding) not jail time.

Law enforcement does not have to provide you with legal counsel at all. The accused/suspect has to contact his/her own attorney. The cops must cease questioning once an attorney is requested; if they continue to question after the person asserts his constitutional right to an attorney, any statement made by the accused/suspect may be suppressed (not allowed in court proceedings). But these are very complicated legal issues.

"Priors" drop off in 10 years. Expungement is difficult since you had multiple convictions. Even with expungement, the convictions show on your DMV report.
