How much time can I be sentenced to?

Criminal Law lawyer at Nelson & Lawless
How much time CAN I be sentenced to? The full term of any remaining sentence of the prior charge, plus the max on the new charges, subject to time served and good time credits if applicable. What WILL happen is up to your attorney to fight and negotiate for in plea bargaining, or from the judge in sentencing if you take it to trial and lose. You aren't going to get any better answer, other than from raw speculation. However, if handled right, and you don't piss off the DA and judge, probation can many times be restored along with a plea bargained penalty package on the new charges. Return to jail is not automatic just because you have been violated.

When you go to court, show the D.A. and judge your license. You may have to pay a fine, but you will avoid jail.
