Am I looking for jail time or probation for a Class D Felony Theft?

Answered by attorney Kathryn L. Hudson (Unclaimed Profile)
Criminal Law lawyer at Law Office of Kathryn L. Hudson
A class D felony carries a maximum prison sentence of six years along with fines and court costs. If you do not have an attorney you need to retain one right away. With your prior misdemeanor theft charge the prosecution might try to use that to enhance your sentence, an attorney can get between you and the prosecutor and negotiate the best possible outcome. Ideally what you would hope for would be probation only and taking a guilty plea if that is warranted under the First Time Offender statute that will allow allow you to have your felony conviction expunged and sealed after you complete your probation.

How can I see my boyfriend if my dad put a no contact order on him?

Answered by attorney Loren M. Dickstein
Criminal Law lawyer at Lewis Dickstein P.L.L.C.
If your dad got a court order preventing you from seeing your boyfriend, you or your boyfriend risk being held in contempt of court for a violation of the order. Maybe ask your dad to have a joint therapy session or a meeting with a mutually agreed third party and try to work our your differences.
