There should be no reason why you can't borrow from your 401k to get your attorney's fees. You are basically just borrowing from yourself and it has to be paid back.

Yes, if you are a joint signor on a credit card account and the other signor files bankruptcy you remain liable for that debt. The only way you can be removed as a signor would be for the credit card company to agree to release you from liability, and it is very unlikely that will happen.

All debts are listed in a bankruptcy. There are no exceptions. However the bankruptcy ought not to affect your brother as long as you keep the payments current & sign a reaffirmation with the car lender.
