Can I file bankruptcy even if there is a law suit filed against me? And if yes, what kind of bankruptcy?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Yes, you can file with a lawsuit pending. Whether the debt is dischargeable under bankruptcy law depends on what the suit is about. As for what chapter, that depends on goals for the bankruptcy, your income, and your equity in your assets.

If your father left an estate (even though he had no will) you should consult an estate/probate attorney. You have a few weeks left in which you can open a probate estate and this procedure will possibly shelter you from some debts, etc. that your father left. If this is what you are hoping for you will be limited in how you benefit from his estate. You need the help of an estate attorney. This is true even if you have the title document - title still has to be changed from your father's name to yours and a court order or other documentation from the court will be required by the Department of Revenue to transfer the title.
