How do I get the money back from garnishment?

Answered by attorney David Goldman
Bankruptcy lawyer at Law Office of David M. Goldman PLLC
Your bankruptcy lawyer should be able to deal with this. Depending on the type of bankruptcy and what the money was from, it may not help you but only increase what the trustee gets to give to the creditors.

Am I responsible for that debt even after the discharge?

Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
After you file your petition, your personal liability for the assessments due as of that date will be discharged. However, if the HOA has a lien on the property, that lien will most likely remain on the property. Additionally, you will be liable for all assessments accrued after the date of filing, as long as you are on title.

Can I still file for bankruptcy if I am paying back creditors monthly?

You can file bankruptcy at any time. The only question is under what chapter and whether you will have to make payments to the trustee.
