The filing fee for a chapter 7 is $306. Attorneys fees vary. You can file bankruptcy and keep the home as long as you pay the mortgage. You can get out of the credit card debt and most all other debt.

If no assets or creditors were left out of the papers that were filed, you do not need to amend the schedules. They are prohibited from contacting you and there may be a violation of the automatic stay if they have. You also do not need to send creditors proof that you have filed or that the debt to them has been discharged. They already got notice that you have filed. Often, one department of a large bank does not know what the other department knows. If a bank tries to collect a debt which has been discharged, there may be a violation of the Federal automatic stay.

You have no choice, you must list all of your debts in your bankruptcy. While over payment of unemployment benefits can typically be eliminated through bankruptcy, if there is a tax lien, you have been exceptionally unlucky, as liens of this nature cannot be eliminated through bankruptcy. However, if the equity in your property is less than the amount of the lien, the lien may be lowered to the total value of your property. Sorry, state exemptions dont apply!
