What is the name of the form to amend?

Answered by attorney Roxanne Eberle (Unclaimed Profile)
Bankruptcy lawyer at Wild Sky Law Group, PLLC
You need to amend the existing schedule listing the creditors along with the mailing matrix for the court. You will also need to send the amended schedules and the Notice of the Meeting of the Creditors to the new creditors that you list and then file a Certificate of Mailing with the court. You want to make sure to add all the creditors at one time because it will cost you $30 each time you amend the schedules.

Is there any way around this other than foreclosure?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
A deed in lieu is asking the mortgage company to do a favor for you so they are entitled to ask for whatever they wish in exchange for this favor. I suspect you might do better with a short sale instead.

What can I do if the attorney told me I had 10 days to refile but I did still don't have my car?

Peter Maurice Lively
Answered by attorney Peter Maurice Lively (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Peter M. Lively
It may be possible to reopen your case or file a new case and obtain possession of your vehicle. If you start a new case after one dismissed case within the past year, the automatic stay will expire after 30 days unless you prevail on a motion to extend the automatic stay at a hearing held within 30 days of the petition date. You should consult with a bankruptcy attorney regarding your specific facts and circumstances.
