Depending on the wording of the contract, you should be able to catch up the arrearage (1 month behind) and continue to make the "lease payments" outside of the Chapter 13 plan. It will be important for you to bring that contract to the lawyer to review it to see if he or she can work with the owner to re-write the contract more favorably for you. Without reviewing the contract, I can't really give you any more advice.

Your plan is flawed. If you sell your home and use the money to pay relatives, the payments will be considered a "preference". The trustee of your bankruptcy case may demand that your relatives turn the funds over to the court so that they can be distributed evenly among all of your creditors. You might be better off to exempt the home in your bankruptcy if you are able and then sell the home after the bankruptcy is completed. You could then use the funds to pay whatever creditor you choose.

Not entirely sure what you mean, but bankruptcy law requires every debtor to list all property they own. Just because the vehicle is in your name alone doesn't mean that your spouse couldn't claim an interest in it. If you divorced your husband, I bet you would claim that you had an ownership interest in his pension, which is in his name alone. What's sauce for the goose is sauce for the gander, as they said when I was little.
