Second mortgages are a typical example of using one collateral for two loans. All loans are subject to the lending practices of the institutions to which application is made. Getting two loans on a single motor vehicle would probably not be possible, unless perhaps the car is worth really big bucks because it is very rare and in excellent shape. In other words, collateralizing personal property for two separate loans is probably not possible, but it is done frequently with real estate.

I am sorry to have to let you know that it is not likely that you will be able to use bankruptcy to eliminate any of your student loans. Bankruptcy is a program that is available to help those who cannot pay their debts either eliminate these debts or restructure their debts to make them easier to repay. Most kinds of debts are eligible to be eliminated through bankruptcy, such as medical debt, credit cards, repossession costs, and even tax debts. Child support, alimony and student loans are not eligible to be eliminated in a bankruptcy as a matter of public policy, although repayment can be managed by a program in bankruptcy called Chapter 13.

Depending on the wording of the contract, you should be able to catch up the arrearage (1 month behind) and continue to make the "lease payments" outside of the Chapter 13 plan. It will be important for you to bring that contract to the lawyer to review it to see if he or she can work with the owner to re-write the contract more favorably for you. Without reviewing the contract, I can't really give you any more advice.
