What can we do about the second mortgage?

Answered by attorney Jeffrey M. Cook (Unclaimed Profile)
Bankruptcy lawyer at J.M. Cook, P.A.
If I understand correctly, you are trying to do a deed in lieu to the first mortgage holder. This will not work and won't be accepted by the bank. In a foreclosure, the first could avoid the second lien. A deed in lieu would simply put them in the same position as you and the second lien would still attach.

What are my options after I received an email from the magistrate regarding my loan?

default-avatar
Answered by attorney Douglas William Cameron Forsyth (Unclaimed Profile)
Bankruptcy lawyer at Dion & Forsyth, P.A.
This has the feel of a common scam perpetrated against innocent individuals. Do you have any knowledge regarding the loan or is this the first time you have heard of it? Obtain verification of the debt before paying anything. They are required by federal law, after written demand, to provide verification of the debt. Even then I would not make a payment as this does not appear to be a legitimate debt collection agency / law firm. Even in the letter they have violated the Fair Debt Collection Practices Act.

What needs to be done in order to file for bankruptcy?

Answered by attorney Thomas Anthony Vogele (Unclaimed Profile)
Bankruptcy lawyer at Thomas Vogele & Associates, APC
Get all of your financial information together (assets, liabilities, income and expenses) and then contact a good bankruptcy attorney. If you need a referral, contact your local bar association or the U.S. Bankruptcy Court. Make sure you disclose everything to your attorney and comply with all of the rules. While bankruptcy is never easy and not to be used without good reason, when you are through the process you will receive a fresh start and can start rebuilding your financial life. Good luck.
