Can an employer not hire me if they saw that I had filled bankruptcy this year due to a divorce which caused me not to get the job?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)

Section 525 of the Bankruptcy Code generally prohibits employers from discriminating against employees in hiring, promotion, pay, benefits, etc. There are a few exceptions. Generally, of course, employers can come up with lots of reasons for not hiring someone other than the real one. So you would do well to get real proof of their impermissible reason-if it is impermissible. Consult a local experienced bankruptcy lawyer to find out what the attitude toward this kind of allegation in your federal district.

How much debt you have to currently be in to file for bankruptcy?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
It is not a question of minimum, but more a question of maximum. You can not file for a Chapter 13 if your general unsecured is over 337,000 and/or your secured debt is over 1,010,650. There is no minimum debt requirement, but it may not be worth it, if you have below 3,000 as most attorney charge that for a c7. Hope this helps as you really did not give a lot of information to go develop an answer from.

When can I declare bankruptcy again after filing eight years ago?

You can file a Chapter 13 plan now. If you qualify for a Chapter 7, you will need to wait until 8 years have passed from the day you filed a previous, successful Chapter 7.
