Responding that the action is out of statute and if they file suit you will counter-sue for costs and sanctions for filing a frivolous action should be enough for them to continue collection and sue. Demand they cease and desist all collection action. What do you mean by "Informal Bankruptcy?"

If we had a consultation to file chapter 7, we decided it would be best not to file, can we receive the full $995 we paid upfront?

If you paid $995 down for a bankruptcy, you ought to be able to obtain a refund for any funds not used to perform work on the case. However, if you relied on your credit report to determine that you have no debts that can be discharged in bankruptcy, I think you have employed a faulty logic. My office can help with refinancing your student loans into more attractive programs, and we do not use bankruptcy to obtain this result.

If the judgment is against an unincorporated business, then you are personally liable for the judgment. If the general contractor owes it you should have brought them into the lawsuit with a "Third Party Complaint." If the judgment was obtained by default you may be able to vacate the default and defend it.
