If I filed chapter 7 on Dec 31 2016, do I need a defense for a motion for relief from automatic stay?

Answered by attorney Christopher J. Kane
Bankruptcy lawyer at Christopher J. Kane, P.C.
If you are behind on the mortgage payments, you have no defense and the court will grant the motion for relief from stay. However, it probably won't affect you if you still plan to move out of the house this month, in April. After the mortgage company obtains relief from stay they still have to schedule a foreclosure date, which takes time.

A deed in lieu is asking the mortgage company to do a favor for you so they are entitled to ask for whatever they wish in exchange for this favor. I suspect you might do better with a short sale instead.

Depends.  Did they know you were gone, what service was really done, did they hang it on the door?  At this point, you need legal help.  Funny, they can find you to get your account, but not find you for service.
